TERMS OF SERVICE (TOS)

All clients are expected to fully read my TOS before commissioning me

✧ GENERAL TERMS ✧By commissioning me, you are agreeing to all of the terms of service listed below. My TOS is subject to changing at any time and will be effective immediately upon changing; they will also transfer over to any current commissions.Ordering and payment will be made through VGen.
Communication will be done through Discord or Email.I DO NOT WORK WITH ANYONE ASSOCIATED WITH NFTS
OR CRYPTOCURRENCY BASED ART TRANSACTIONS➤ DO NOT steal, trace, edit, sell, or claim my work as your own!!
➤ Please credit my Twitter @LustriaVT in the panels, bio, description, and other related spaces.
➤ I reserve the right to use any commissioned work on my websites, social networking sites, videos, streams and for promotional purposes.

✧ PAYMENTS ✧➤ Full payment required before I begin your commission. For larger commissions over $200, I will allow 50% upfront and 50% upon sketch approval. I will not continue the commission until the invoice is paid in full after the sketch approval.➤ All payments are handled by the VGen payments system.➤ Prices depend on complexity of character design and extra items.

✧ PROCESS & REVISIONS ✧1) Provide a clear commission request (Reference images, specific requests written down, etc.).2) I can accept or decline the commission request, ask any additional clarifying questions, and provide a price quote.3) It takes roughly 2 weeks up to 3 months to deliver your commission, upon receiving payment (depending on commission type). If during the process I find that it may take longer, I will notify you immediately.4) I will fix character design errors for free as long as clear references are provided when you request a commission. Any other revisions may include extra fees.5) I provide two revision opportunities:
Sketching stage (ex. pose alterations, adding/removing large elements)
Flat Coloring stage (color changes, slight repositioning, adding/removing small elements).After the commission request has been finalized by both the commissioner and the artist, no more revisions can be made. If the client fails to respond to revision approvals after 7 days, the commission is considered complete.

✧ COPYRIGHT & USE POLICY ✧➤ I reserve the rights to stream the art process and to post process screenshots and final images to my social networking sites, portfolio, and websites unless confidentiality is specifically requested.➤ The commissioner may use the artwork for personal use. No direct or indirect form of income unless you purchase a commercial license. You can share and promote yourself on social media, use as profile pictures/banners on social media, and print for yourself.➤ No resale or minting my artwork for NFTs, AI or any crypto-currency related activities.

✧ COMMERCIAL LICENSES ✧➤ Promotional material 1.5x price
Twitch, YouTube, online shop, website, game illustrations, etc.
(Using on stream as an asset, scene illustration, video thumbnail, shop banner, monetized promotional video)➤ Selling merchandise 2x price
Prints, stickers, charms, anything that is reproducing/using the artwork for money

✧ REFUNDS ✧➤ NO REFUNDS: be sure of what you’re wanting before ordering!
